Correcting codification error by reinstating language that provided for filling of council vacancies
Shall the Charter, pursuant to Ordinance 2019-08, be amended to correct a codification error by reinstating language that provided for the filling of vacancies on the City Council?
This amendment is intended to correct a clerical error that led to the deletion of language in the City Charter that provided for a special election to fill council vacancies in the event of a resignation, death, or the authorized removal of a Council member from office.
A "yes" vote would...
- Revise the City Charter (Section 3.07) adding language to make explicit the procedures for the replacement of a Council member who has vacated their term.
- Potentially safeguard the City from legal challenges, and the associated costs, stemming from elections to fill vacancies by a process not specified within the City's Charter.
A "no" vote would...
- Fail to define the process required to fill a Council vacancy, which could cause confusion and procedural delays.
- Potentially expose the City to legal challenges and the associate costs, stemming from elections to fill vacancies by a process not specified within the City's Charter.
